Terms and Conditions and Waiver of Liability, Assumption of Risks

As a willing participant in Music Together® classes with East Bay Music Together, my family and I agree to the following: 

ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes 

(including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at East Bay Music Together, and present an inherent risk that cannot be eliminated. I acknowledge that, although East Bay Music Together is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes between people in our classes (including Music Together^® teachers, and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children, including all adults, and children 2 or olds. I understand and agree that as a registered family with East Bay Music Together, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases. 

I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue East Bay Music Together and its owners, managers, contractors, members, employees, agents, and volunteer (“Released Parties”) for any claims that may arise out of or relate in any way to my or my child’s exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. 

I understand that East Bay Music Together may occasionally choose to communicate by text message for time sensitive communications, and agree to receiving those communications during the semesters that I am registered for class. To opt out, I understand an email is required to [email protected].

The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties. 

I understand that classes may be cancelled or consolidated with advanced notice.

I understand that participation in physical activity including dance movement and instrument play can result in injury. By attending classes, I agree to waive my rights to hold East Bay Music Together, Music Together LLC, it's teachers, and/or the owners of the teaching facilities liable for any personal injury or damage to personal property that might occur during participation in class at East Bay Music Together, or any personal property damage that may occur to my guests when they visit a class. 

PRIVACY STATEMENT: I authorize East Bay Music Together to share my contact information with Music Together Worldwide as part of their ongoing licensing agreement. I understand that this information will not be sold or shared by Music Together Worldwide and that I may unsubscribe from Music Together Worldwide email communications at any time.

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. BY 

ENROLLING IN CLASSES AT EAST BAY TOGETHER, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.
